What is alleged to have happened

The Securities and Exchange Commission announced this matter on March 29, 2023 as release LR-25679. The SEC obtained a restraining order and asset freeze and alleges that Perera misappropriated at least $3.3 million of one investor's $4.3 million through leveraged trading, then hid the losses with false statements and Ponzi-like payments from other sources' money.

This library tags the matter as a Ponzi scheme because the document describes returns to earlier investors paid from later investors' money, as alleged or found. The tagging is ours, not the regulator's: agencies charge statutory provisions, not technique names.

A parallel criminal proceeding is referenced. Civil and criminal outcomes are recorded separately, because they resolve on different standards of proof.

On May 6, 2025 the Eastern District of New York entered a final judgment against Perera on his consent. It permanently enjoins him from violating the antifraud provisions of the securities and advisers laws and makes him liable, jointly and severally with Janues Capital Incorporated, for disgorgement of $3,304,357.75 and prejudgment interest of $565,649.70 (a total of $3,870,007.45). The court treats that amount as satisfied by the restitution ordered in the parallel criminal case, United States v. Perera, and by the transfer of $78,349 of frozen funds. The judgment records no civil penalty. The outcome for Janues Capital and for relief defendant Nishani Alahakoon was not checked.
