In September 2017 the SEC charged eight people, led by a former Life Time Fitness vice president, in a chain of tips about the company's going-private deal; six traders allegedly made about $866,000 on out-of-the-money calls. We found consent judgments for two of the eight: Fleming (September 17, 2018, with a permanent officer-and-director bar) and Austin Mansur (June 11, 2019).

What is alleged to have happened

The complaint alleged that Fleming tipped his friend Beshey in exchange for a share of profits, that Beshey passed it to Bonvissuto and Kourtis, and that Kourtis passed it to Carlucci, Kandalepas, Mansur and Weller. Kickbacks included about $10,000 in cash to Fleming and, from Weller, marijuana to Kourtis. The SEC announced it on April 4, 2018 as release LR-24095, and a parallel criminal case exists.

Outcome: the final judgment as to Fleming, dated September 17, 2018 in the Northern District of Illinois, records his consent, permanently prohibits him from acting as an officer or director of a public issuer, and orders $9,500 in disgorgement with $856.92 in interest ($10,356.92 in total, payable in installments). The judgment as to Mansur, dated June 11, 2019, records his consent and orders $133,326.01 in disgorgement and $21,885.30 in interest. The money fields sum those two. The documents do not show civil penalties. We did not find or check the outcomes for Beshey, Bonvissuto, Kourtis, Carlucci, Kandalepas or Weller, so the case may not be fully resolved.
