What is alleged to have happened
The Securities and Exchange Commission announced on October 26, 2018 (litigation release 24325) that on October 10, 2018 the U.S. District Court for the Eastern District of New York entered a final judgment on consent against Kueber in SEC v. Kueber, filed July 31, 2015.
The complaint alleged that Kueber concealed his control of Cynk Technology Corp. and its purportedly unrestricted shares through nominees and straw shareholders. Cynk's stock rose to over $21 on July 10, 2014 with no assets or operations, and the SEC's July 11, 2014 trading suspension stopped him profiting. In the parallel criminal case he pleaded guilty, forfeited $1.2 million and received three years of supervised release.
The consent judgment permanently enjoins violations of Section 17(a), Section 10(b) and Rule 10b-5 and imposes permanent officer-director and penny-stock bars. The release states no SEC money figure, so none is recorded; the $1.2 million is a criminal forfeiture. This library tags the matter as undisclosed control blocks.
