What is alleged to have happened
The Securities and Exchange Commission announced this matter on September 19, 2023 as release LR-25833. The complaint alleged that MFB 111 Investment and its president raised about $1.8 million from at least 170 investors in the Haitian-American community, misappropriated at least $186,000 and made Ponzi-like distributions.
This library tags the matter as a Ponzi scheme because the document describes returns to earlier investors paid from later investors' money, as alleged or found. The tagging is ours, not the regulator's: agencies charge statutory provisions, not technique names.
Outcome: the Southern District of Florida entered a judgment on June 10, 2024 against both defendants after they consented to its entry without admitting or denying the allegations. The judgment enjoins them but leaves disgorgement, prejudgment interest and civil penalties to be decided on a later SEC motion. A proposed final judgment against Bien Aime, attached to a November 2024 filing, would impose disgorgement of $270,080, interest of $48,593 and a $270,080 penalty; it is unsigned in the copy I read, and I did not confirm that it was entered, so no money is recorded here.
