What is alleged to have happened

The Securities and Exchange Commission announced this matter on September 21, 2023 as release LR-25842. The SEC obtained an asset freeze and restraining order and alleges that Kubler and his companies raised about $5.6 million, invested only about 4% as promised, and made Ponzi-like payments to earlier investors. Two entities are named as relief defendants.

This library tags the matter as a Ponzi scheme because the document describes returns to earlier investors paid from later investors' money, as alleged or found. The tagging is ours, not the regulator's: agencies charge statutory provisions, not technique names.

The final judgment, dated January 22, 2025 in the District of Nebraska, recites that the defendants and relief defendants consented to its entry without admitting or denying the allegations. It enjoins all defendants from antifraud violations and bars Kubler from participating in securities offerings except for his own account. It orders disgorgement and prejudgment interest in five parts, some owed jointly with entities (including relief defendants Kubler Financial and Midwest PEG), and civil penalties of $500,000 against Kubler and $100,000 each against Kubler Consulting, Aksarben Evolution, AV Bhill, CFH Texas and Green Saddle.

The stored figures add the five disgorgement parts ($947,216.11) and the five interest parts ($262,327.46), counting each jointly owed part once. The document does not describe any criminal case.
