In October 2018 the CFTC sued Aaron Michael Scott of Portland and his company Blue Moon Coins over alleged non-delivery of gold and silver to more than 130 customers. Scott consented to an order, signed on 17 December 2020 and announced in April 2021, requiring $1,381,461.86 in restitution and permanently barring him from CFTC registration and trading; he had received a four-year prison sentence in 2019.

What is alleged to have happened
The CFTC filed the complaint in the Western District of Washington, announced October 3, 2018 (release 7822-18). It alleges that from October 2013 to April 2014 Scott and Blue Moon claimed to hold or to buy metals for orders, kept little or no inventory, and misappropriated most of the money. Some customer funds went to refund or fill other customers' orders, which the release describes as in the nature of a Ponzi scheme, a side detail of a non-delivery fraud. The CFTC asked for restitution, disgorgement, a penalty and bans.
The CFTC's press release of 27 April 2021 and the court's consent order show how the case ended. The order, which the Western District of Washington signed on 17 December 2020, resolves all charges against Scott without a trial, permanently enjoins him from violating the Commodity Exchange Act, bars him from registering with the CFTC and from trading in commodity interests, and requires restitution of $1,381,461.86 to defrauded customers. In the parallel criminal case Scott pleaded guilty to wire fraud and on 5 April 2019 was sentenced to four years in prison (48 months). The press release mentions no civil penalty, and restitution has no dedicated field in this record, so the money fields stay empty. The order names Scott only; the dissolved company BMC Worldwide is not addressed in what we read.
