In November 2017 ASIC announced that Jin Xi Li of Caloundra, Queensland, had been charged with 88 offences alleging that he traded and procured others to trade PanAust CFDs on inside information about a takeover bid. In 2022 he pleaded guilty to two offences and ASIC reported on 20 June 2022 that he was sentenced to nine months' imprisonment, released on a two-year good behaviour recognisance.

What is alleged to have happened

ASIC alleged that Li held inside information about Guangdong Rising's bid for PanAust Limited, announced on March 30, 2015, when he acquired PanAust CFDs on 32 occasions in March 2015, procured others to acquire them on 55 occasions, and communicated the information to another person. The charges were laid under section 1043A of the Corporations Act. He appeared in Maroochydore Magistrates Court, was bailed, and the matter was adjourned.

Outcome: ASIC release 22-010MR (28 January 2022) says Li pleaded guilty in the District Court at Brisbane to two counts, trading while in possession of inside information and procuring his wife to trade, over CFD purchases of 390,000 and 265,000 contracts in March 2015 with combined profits of about $343,000. ASIC release 22-149MR (20 June 2022) says he was sentenced to nine months' imprisonment and released forthwith on a recognisance to be of good behaviour for two years. The releases do not say what became of the other charges laid in 2017. The matter was prosecuted by the Commonwealth Director of Public Prosecutions; the date used is the release date, since the sentencing date is not stated.
