What is alleged to have happened

The SEC announced the judgments of November 20, 2020 on November 24, 2020 (LR-24969); the case is 5:19-cv-01517. Werth turned out to be running a Ponzi scheme, and three clients lost over $650,000. Rumbaugh was charged with misleading clients and concealing self-dealing, not with operating the scheme.

The Ponzi tag is removed: Werth operated the scheme, and Rumbaugh is charged as a conflicted adviser. The record omitted the penalty and named "Rumbaugh et al".
