What is alleged to have happened
The Securities and Exchange Commission announced the settled complaint on September 21, 2020 as litigation release 24908, filed in the Central District of California.
The complaint alleges that between February 2016 and March 2018 Jacobs traded the stock of companies he was helping with their earnings releases, gaining or avoiding losses of more than $79,000. In one example a chief financial officer emailed him draft quarterly results and he bought 23,500 shares before the release.
Without admitting or denying the allegations, Jacobs consented to an injunction, the penalty and the bar. The settlement is subject to court approval, so the status is settled rather than a final judgment.
