In July 2024 the SEC sued John J. Kralik V and his companies JKV Capital and JKV LLC over alleged false statements and misuse of investor money in five real estate funds. The case was dismissed upon settlement in December 2025, and on August 20, 2026 the court entered a consent judgment that enjoins the defendants; disgorgement, interest, penalty and any officer-and-director bar were left for the court to set later.

What is alleged to have happened

The Securities and Exchange Commission announced this matter on July 2, 2024 as release LR-26043. The complaint alleges that Kralik raised over $16.9 million from about 35 investors for five real estate funds, misappropriated more than $1.6 million and moved money between the funds, including Ponzi-like distributions. JKV Homes, LLC is a relief defendant. An officer-and-director bar is sought.

This library does not tag the matter as a Ponzi scheme: on a source check, the document mentions Ponzi-like payments only in passing, or as part of another party's scheme, and the charges are about something else. The tagging is ours, not the regulator's: agencies charge statutory provisions, not technique names.

Outcome. The docket (C.D. Cal. 8:24-cv-01460) shows an order of dismissal upon settlement on December 10, 2025, which allows the case to be reopened on request, and a judgment as to the defendants entered on August 20, 2026 (Document 64). In that judgment the defendants consented without admitting the allegations. It permanently enjoins them from violating Section 10(b) and Rule 10b-5 and Section 17(a) of the Securities Act in the ways described, and says the amounts of disgorgement, prejudgment interest (running from March 1, 2022) and any civil penalty, and whether to order an officer-and-director bar, will be decided on a later SEC motion, with the defendants barred from disputing liability then. We found no order setting those amounts, so no money is stored. The judgment names Kralik, JKV Capital and JKV LLC; the relief defendant JKV Homes, LLC is named in its caption but we did not check how its claims ended.
