Checked against the primary document on October 2, 2026. The library's summary, tags and figures for this record were compared with the regulator's own document by an AI model (Claude) following written instructions, with sampled and disputed records read a second time. No lawyer has reviewed them. A checked record can still contain errors, and checked does not mean endorsed. See how we check records or report a correction.

What is alleged to have happened

On May 2, 2017 the SEC accepted a settlement with David Michael Burke, a former registered representative who also controlled Komak Investments, LLC. The order is a follow-on to a September 2015 South Carolina Securities Commission order, which found that in 2013 and 2014 he offered unregistered investment contracts under state law and misled an investor with fabricated trading reports, and to a December 2015 consent order that barred him in that state.

The $5,000 civil penalty the record previously showed was the penalty the South Carolina order imposed on Burke and Komak, not an SEC penalty. The SEC order finds no Section 5 violation, so the record carries no technique tag and no penalty.

This library does not assign a technique tag to the matter, because no technique page in the current taxonomy describes the conduct the document records.
