What is alleged to have happened
The CFTC announced the complaint on December 10, 2021 as release 8468-21. It alleges that Miller and Omerta received confidential block order information from an energy company trader and traded on it, including non-arm's-length block trades. No technique tag is applied.
Outcome: CFTC enforcement update 9168-26 (January 16, 2026) reports a consent order in the Southern District of Texas under which Miller and Omerta pay, jointly and severally, $135,788 in disgorgement and a $200,000 civil monetary penalty, with 18-month trading and registration bans, a five-year block-trade ban and an injunction. A later CFTC release (9178-26, February 2, 2026) gives the order date as December 22, 2025, which is the date recorded. The update says Miller pleaded guilty in December 2021 and was sentenced in June 2024 to five months in prison plus five months of home confinement, with $135,788 forfeited. Neither release states that the order is a finding after contest; it is a consent order.
