Settled

Checked against the primary document on October 2, 2026. The library's summary, tags and figures for this record were compared with the regulator's own document by an AI model (Claude) following written instructions, with sampled and disputed records read a second time. No lawyer has reviewed them. A checked record can still contain errors, and checked does not mean endorsed. See how we check records or report a correction.

What is alleged to have happened

The Commodity Futures Trading Commission announced the consent order on February 23, 2021 as release 8364-21; the order was entered February 19, 2021.

The order finds Eibschutz solicited and received from NYMEX employees, on many occasions between 2008 and 2010, non-public information about derivatives trading, including counterparties, prices and volumes, and is liable for aiding and abetting the employees' disclosures. The release calls it the first CFTC action against an exchange for disclosure of such information.

The conduct is receiving and encouraging disclosures, not trading on inside information, so the insider-trading tag has been removed.
