What is alleged to have happened

The CFTC announced the order on October 12, 2021 (release 8447-21) in the Eastern District of New York; the defendants admitted its findings. It resolves the June 2020 complaint. The order finds they did no trading, spent on personal costs, and paid purported profits to some participants in the manner of a Ponzi scheme; restitution is offset by any criminal restitution.

The record showed the headline $370,000 as a penalty, when it is $345,000 restitution plus a $25,000 penalty, and omitted the bans. The Ponzi tag is removed because the order finds pool fraud with Ponzi-style payments to some participants.

This grouping is the library's, made by matching names, techniques, dates and citations when the site is built. It is not the regulator's or a court's determination that the records are one case, and it errs towards missing a link rather than making a false one.
